The process
Stage 1
Give your tenant notice using the correct form
Important points to note
You must use the correct section notice
You must state the dates, amounts and weeks late that are due
You must place the tenants deposit in a deposit protection scheme within 28 days
You must be able to prove the tenant has received the notice
Stage 2
If the tenant has not left the property or put the account in good order, you have to request for possession order.
The possession order must be requested a set time after the section notice has expired
Depending on how busy the county court is the date could be 2 or 3 months from the date you apply
You are able to apply online using Money Claim Online
Please request for permission to transfer the case to High Court Enforcement when applying for the possession order. This one line is guaranteed to save you money and time.
Stage 3
If the tenant has not left the property after the possession date has passed, and even if they have to protect yourself, then you need to arrange for an eviction date.
If you have followed all the advice correctly, the time difference from the possession order date, could be 3 days to get you property back - or 3 months, yes 3 months!

That includes all your court fees, writs, transfer up your case, checking all your documents, and high court enforcement attendance to evict your tenants. No small print, this does not include the cost for changing locks (advisable) but does include the attendance of high court enforcement officer for 1hr, subsequent hours are charged at £150 per hour.
Please note that some high court enforcement officers charge over £1000 for the eviction alone and this does not include at court fees and subsequent hours are charged at £195 per hour - and then you have some high court enforcement that charge £700 excluding court fees. In any case high court enforcement officers usually are only involved for a couple of week. We manage the entire process for you, which could easily take 3 to 6 months, and we do this for a fixed fee.
